Mediation Rates

Mediation rates/fees are as follows:

  • Half day (½) (initial 3 hours) – $1,800.00 plus HST;
  • Full day (booked as such) – $3,000.00 plus HST.

In the event that a half-day mediation session extends beyond three hours, with the consent of all parties, the hourly rate charged is $500.00 for each additional hour or part thereof, to the full-day maximum of $3,000.00.

Half-day mediations conducted at a location which requires 1.5 hours or greater in travel time from Ottawa, Ontario, are charged the full-day rate as set out above ($3,000.00 plus HST).

Family Law Mediation Rates

Family Law mediations will be booked on a daily basis and charged a daily rate/fee of $5,000.00 which is inclusive of preparation and travel times.  Each mediation day will consist of 6 hours.  In the event that a mediation session extends beyond 1 day, with the consent of all parties, the hourly rate charged is $600.00 for each additional hour or part thereof.

Arbitration Rates

Arbitrations are charged at a daily hearing rate/fee as follows:

  • Within Eastern Ontario –  $4,000.00 plus HST;
  • Outside of Eastern Ontario, but within domestic Canada – $10,000.00 plus HST;
  • International (outside of Canada) – $15,000.00 plus HST.

Additional fees are charged for case preparation (document review, conferences, motions etc…), travel as well as deliberation and award drafting times. There will be 6 hours of hearing time for each hearing day.

Cancellation Fees

If a mediation is cancelled less than ten (10) working/business days before its scheduled date, one half of the ½ day rate of $1,800.00 ($900.00), plus HST, will be charged.  In the event of a full day mediation being booked and cancelled as stated, then the ½ day rate of $1,800.00, plus HST, will be charged.  The cancellation fee will be divided among the parties, unless the Mediator is advised as to who will be paying the cancellation fee.

If a Family Law mediation is cancelled less than ten (10) working/business days before its scheduled start date, one half (50%) of the rate/fee for the time booked, plus HST, will be charged.  The cancellation fee will be divided among the parties, unless the Mediator is advised as to who will be paying the cancellation fee.

If an arbitration is cancelled less than fifteen (15) working/business days before its scheduled start date, one half (50%) of the rate/fee for the hearing time booked, plus HST, will be charged.  The cancellation fee will be divided among the parties, unless the Arbitrator is advised as to who will be paying the cancellation fee.

Terms

Unless otherwise directed from counsel, the parties personally, and the solicitors acting for them, jointly and severally agree to pay Bansie Dispute Resolution Services Inc.’s (BDRS) fees. BDRS’s account shall be rendered to the parties forthwith after the completed event and shall be payable within 30 days of receipt. Interest will thereafter accrue at the rate set out under the Solicitors’ Act.
